Volleyball Waiver

Volleyball is an indoor game that has inherent risks, hazards, and dangers. These risks cannot be eliminated, particularly in a competitive environment. Volleyball participants may have contributed to their own injury by a number of factors, including wearing inappropriate footwear, being pushed, being inebriated, or even being reckless. In this situation, a timely and descriptive incident report is critical. Assumption of risk and waivers such as volleyball waiver and consent are similar defenses to a tort claim. Generally, courts will uphold these agreements only if it is unmistakable that the parties’ intent was to shift the risk of loss. This is why it is important that the volleyball waivers are well drafted and all participants have signed the volleyball waiver prior to participating in any intramural competition. The participant may be barred from bringing an action so long as they have signed the volleyball waiver and it is clear that they intended to absolve the intramural program from any liability arising from negligence.
The volleyball waiver, which is included on the official entry form, must be signed. If you are under 18 years of age your parent must sign the form for you.
The volleyball waiver includes as expressly agreed that participation in the Volleyball tournament event shall be undertaken at the sole risk of the undersigned and that the Fund shall not be subject to any claim, demand, or for any losses, damage, injury or death caused to any individual, individual’s family or guest, from any causes whatsoever. This includes injury or damage caused by negligence, gross negligence and/or intentional acts. Every individual for himself/herself and on behalf of his/her spouse, children, guest, executors, administrators, successors and assigns, does hereby expressly forever release and discharge the owner’s fund and the company’s annual Volleyball Tournament, their agents, employees, successors, and assigns for all such claims, demands, injuries, rights or cause of actions. It is further agreed that as a participant in the Volleyball Tournament the undersigned, and the undersigned’s minor children, knowingly and voluntarily assume any and all risks associated with our participation in this event and agree to abide by all the regulations established by the annual volleyball tournament. Undersigned, for himself and for his minors, further waives the right to bring any claim against the company’s Fund, their officials, volunteers; agents or employees for loss of life, bodily injuries, property damage and/or loss, or personal loss that may be sustained as a result of participating in the
Annual volleyball tournament.
Because no matter how careful you are, accidents happen. And you can be sued by anyone who claims injury or damages resulting from your activities. You may not be liable, but you will need to be defended in court. A liability policy will pay for this defense as well as any costs awarded against you. In short, liability insurance gives you peace of mind.
All players and player’ parent/guardians must check the box for the volleyball waiver and Assumption of Risk Agreement on the form before participating in any athletic endeavors sponsored and/or sanctioned by any club, company or school.

You should probably know that a volleyball waiver does not actually completely indemnify someone against liability, no matter what you put in it. You will need to call your insurance agent also.
